Digital image of med card now acceptable per FMCSA
In light of recent FMCSA rule allowing for electronic documents, a digital image of a med card is now acceptable for law enforcement (e.g. photo of the med card on a cell phone).
As a reminder, under 49 CFR 391.41(a), a driver is not to operate a commercial motor vehicle (CMV) unless he or she is medically certified as physically qualified to do so and, when on-duty, has on his or her person (able to be accessed at any moment while in the driver’s seat) the original, or a copy, of a current medical examiner’s certificate verifying that he or she is physically qualified to drive a CMV.
Compliance shortfalls concerning the Driver Fitness score in the DOT’s Compliance, Safety, Accountability (CSA) program may result in targeted, more frequent roadside inspections, which may endanger FedEx Ground’s ability to operate as a motor carrier. Medical certificate verification is a principal focus and compliance measure during roadside inspections. FedEx Ground’s motor carrier authority is jeopardized when CSPs providing service to FedEx Ground receive DOT violations, including violations stemming from failing to carry a current medical certificate on their person while operating a CMV.
Under the terms of the Operating/ISP Agreement, CSPs agree to comply with applicable federal, state and local laws and regulations, including all DOT driver requirements.
