Ohio became the 24th state where recreational marijuana is legal after voters passed Issue 2 in the November election.

The law does not interfere with any federal restrictions on employment, including those adopted by the United States Department of Transportation.

So, What does this mean to me a FedEx Driver for Slicker Trucking, Inc.

JUDGMENT IS KEY! THIS NEW LEGALIZATION COULD LEAD TO DISQUALIFICATION.

WHAT THIS MEANS TO YOU!

AS A DOT DRIVER FOR FEDEX OPERATING UNDER THE FEDERAL MOTOR CARRIER SAFETY ASSOCIATION THERE ARE SOME THINGS YOU NEED TO KNOW!

  • DON’T USE! This State Law DOES NOT permit DOT drivers to use cannabis or cannabis extract.

  • DOESN’T MATTER! A Medical Marijuana prescription DOES NOT permit DOT drivers to use cannabis or cannabis extract.

  • WE TEST! FedEx requires pre-employment & all DOT drivers are subject to random drug testing, as well as, suspicion testing and post-accident testing.

  • DISQUALIFICATION! A positive test will disqualify a driver from the FedEx system and require immediate termination from the FedEx contractor. Driver will not be eligible to reapply for 1 year + and only after the completion of a Qualified Substance Abuse Program. (SAP is at employees expense)

  • NOT EVEN ONE TIME! Because testing levels have not been established to determine date or amount of usage or intoxication level, ANY positive test will disqualify a candidate at pre-employment testing or ongoing random testing of existing drivers to include suspicion testing.

  • OTHER POSITIVES. Refusal, COC or tampering will be considered a failed / positive drug screen.

  • FUTURE EFFECT. FedEx contractor will be required to report failed drug test, refusal to test as requested on any future DOT Verification of Employment for that driver.

  • ILLEGAL PURCHASE. There are currently no authorized sellers.

  • ILLEGAL POSSESSION. Because retailers, hotels, and other establishments can set their own rules for possession, criminal charges could be filed for possession on premises.

  • CRIMINAL DISQUALIFICATION. Criminal Possession or Intoxication charges can disqualify a driver from FedEx for up to 10 years.

ADDITIONAL NEED TO KNOWS:

  • Slicker has and will continue to establish and enforce drug testing policies, drug-free workplace policies, and zero-tolerance drug policies to include suspicion testing for ALL EMPLOYEES.

  • Suspicion testing may result from a combination of admittance, behavior, smell, paraphernalia, or co-worker report.

  • If an employee is discharged because of their cannabis use, it is considered “just cause” if their use violated the employer’s drug-free workplace policy, zero-tolerance policy, or other formal policy regulating cannabis use.

  • Slicker policy allows for reasonable search of personal property brought onto FedEx property or in Slicker CMV.
